18. Know Your Customer ("KYC")
18.1 PlayBit reserves the right, at any time, to ask for any KYC documentation it deems necessary to determine the identity and location of a User who has made deposits using fiat currencies (traditional currencies such as USD, EUR, etc.). PlayBit reserves the right to restrict the Service, payment or withdrawal until identity is sufficiently determined for fiat currency users, or for any other reason in PlayBit's sole discretion.
18.2 KYC procedures shall NOT be required for Users who conduct all deposits and withdrawals exclusively using cryptocurrencies. Users who maintain purely cryptocurrency-based transactions (Bitcoin, Ethereum, Litecoin, etc.) can maintain their privacy and anonymity without providing identity documentation.
18.3 All transactions may be checked in order to prevent illicit activity, including money laundering, terrorism financing, or trade sanctions violations, consistent with various jurisdictions' laws, regulations, and norms. PlayBit may suspend, block or close user account and withhold funds if requested to do so in accordance with the Prevention of Money Laundering Act or on any other legal basis requested by any state authority.
18.4 Enhanced due diligence may be done in respect of withdrawals of funds not used for wagering. PlayBit also reserves the right to disclose a User's information as appropriate to comply with legal process or as otherwise permitted by the privacy policy, and by using the Service, you acknowledge and consent to the possibility of such disclosure.
18.5 Cryptocurrency AML Screening and Account Freezing: All cryptocurrency deposits are subject to automated Anti-Money Laundering (AML) screening and risk assessment procedures. In the event that a cryptocurrency transaction fails to meet our compliance standards, including but not limited to: (a) low trust score of the deposited funds, (b) evidence or reasonable suspicion that the sender's address has been involved in criminal transactions, money laundering activities, terrorism financing, or other illicit activities, or (c) funds originating from sanctioned entities or addresses flagged by blockchain analysis tools, the following measures shall be implemented:
(i) Immediate Fund Freeze: The deposited cryptocurrency funds shall be immediately frozen and placed in a segregated holding status, preventing any wagering, withdrawal, or transfer activities.
(ii) Account Suspension: The user account associated with the flagged transaction shall be temporarily suspended for a period of thirty (30) calendar days. This suspension period is instituted to allow sufficient time for receipt of official inquiries or requests from law enforcement agencies, regulatory authorities, or authorized governmental agents.
(iii) Mandatory KYC Verification: Upon account suspension, the user shall be required to complete comprehensive Know Your Customer (KYC) verification procedures, including but not limited to: submission of government-issued identification documents, proof of address verification, source of funds documentation, and any additional information deemed necessary by our compliance department. Failure to initiate or complete KYC verification within the thirty (30) day suspension period shall result in indefinite freezing of funds pending investigation.
(iv) Resolution Procedures: If, within the thirty (30) day suspension period, PlayBit receives no official requests, inquiries, or legal demands from law enforcement agencies, regulatory bodies, or authorized governmental agents regarding the flagged transaction, and the user has successfully completed all required KYC verification procedures, the deposited funds shall be returned to the original sender's cryptocurrency address from which the deposit was made, minus any applicable network transaction fees.
(v) KYC Refusal Consequences: In the event that a user refuses to participate in the required KYC verification process, actively obstructs the verification procedures, or provides falsified documentation, the associated funds shall remain frozen indefinitely until all circumstances surrounding the flagged transaction have been thoroughly investigated and resolved. PlayBit reserves the right to cooperate fully with law enforcement agencies and regulatory authorities in such cases, and may disclose all relevant transaction information and user data as required by applicable laws and regulations.
